Avocado VA Terms and Conditions for Online 1×1 Classes

Applies To: All 1×1 Online Language Tutorial Classes offered by Avocado VA LLC

Student Summary

Before enrolling, please read carefully:

  1. You must be 18+ years old. Optional ID verification may be requested.
  2. Scheduling is individual and flexible, but students must honor booked sessions.
  3. Missed classes without prior notice may forfeit make-up rights.
  4. Recordings are supplemental and not a substitute for live attendance.
  5. Avocado VA does not guarantee specific language proficiency outcomes.
  6. Your personal information is governed by Avocado VA’s Privacy Policy.
  7. Internet speed ≥20 Mbps and compatible equipment are required.
  8. Refunds are limited; see the Refund & Cancellation Table below.
  9. Disputes should follow mediation first, with small claims arbitration for disputes under $10,000.
  10. Email is considered a valid legal notice.

By enrolling, you confirm:

  • You are 18+ years old (optional ID verification may be requested).
  • You have legal capacity to enter this Agreement.
  • Enrollment and payment constitute offer, acceptance, and consideration.
  • Electronic signatures, LMS acknowledgments, and payments are binding under Texas law.
  • Email constitutes valid legal notice.
  • This Agreement is governed exclusively by Texas law.

3. Scheduling & Attendance

  • Students are responsible for booking sessions in advance.
  • Sessions must be honored or canceled with at least 24 hours’ notice.
  • Optional make-ups or prorated credits may be offered at Provider discretion.
  • Internet speed ≥20 Mbps and compatible equipment are required.

4. Refund & Cancellation Policy

Refunds may be considered for medical emergencies or verified provider-side force majeure events; requests must be submitted in writing

Notes:

  • Missed sessions without notice are not refundable.
  • Technical issues on the student’s side do not qualify for refunds.
  • Undisclosed fees entitle students to remedies under Texas DTPA.

 

 

5. Fees & Disclosures

  • All fees are disclosed before enrollment.
  • Fee changes communicated promptly.
  • Failure to disclose fees may entitle students to remedies under Texas DTPA.

     

6. Limitation of Liability

To the fullest extent permitted by Texas law:

  • Avocado VA is not liable for technical failures, force majeure events, or unmet learning outcomes.
  • Total liability capped at the amount paid by the student during the prior billing period.

7. Privacy & Data Use

Use of personal information is governed by Avocado VA’s Privacy Policy. By enrolling, students consent to data collection, storage, and use as described.

 

8. Dispute Resolution / DTPA Awareness

  • Disputes must be raised within 30–60 days of the incident.
  • Parties agree to good-faith mediation first.
  • Small claims arbitration may be used for disputes under $10,000.

     

If unresolved, disputes are litigated in Harris County, Texas, under Texas law.

 

9. General Legal Provisions

  • Severability: Invalid provisions do not affect remaining terms.
  • Non-Waiver: Failure to enforce does not waive rights.
  • Non-Assignment: Enrollment is non-transferable without consent.

     

Modifications: Avocado VA may adjust schedules, tutors, or formats for continuity.

3. Student Commitment & Minimum Class Size

3.1 Schedule Commitment

3.2 Technical & Equipment Requirements

  • Internet speed ≥20 Mbps
  • Compatible hardware/software (camera, microphone)
  • Access to required platforms

3.3 Minimum Class Enrollment

  • Each class requires at least 6 committed students.
  • If enrollment drops below 6, Avocado VA may:
    • Merge classes
    • Reschedule sessions
    • Temporarily suspend instruction

 



4. Attendance, Make-Up, and Recordings

  • Repeated violations may result in tutor removal.
